Scope; Third Party Sites. This Privacy Policy applies only to information we collect at and through the Site. Some of our websites and other electronic properties may be governed by their own separate privacy policies. Each website will identify and link to its applicable privacy policy. Our Site may also contains links to third party sites that are not owned or controlled by us. Please be aware that we are not responsible for the privacy practices of such other sites. We encourage you to be aware when you leave our Site and to read the privacy statements of each and every website that collects personal information.

2. INFORMATION WE COLLECT AND WHY WE COLLECT IT

Information You Provide To Us. You can provide information to us on our Site through various means, including: when you register at the Site and/or create an online account; on your account information page; contact us pages and forms; live chat / instant messaging; online email forms; and requests for information forms.

Information We Collect From You. The information we collect includes personal information, such as your name; address; billing address; email address; telephone number; your answers for your account security questions; and when you provide user generated content. In addition, when setting up ACH payments, we collect certain, limited financial information, such as a bank account and routing number in order to process payments on your behalf. You are not required to provide such information, but should you choose not to do so, you may not be eligible or able to participate in or receive the benefit of certain of our services.

No Information From Children Under Age 13. If you are under the age of 13, please do not attempt to register with us at this Site or provide any personal information about yourself to us. If we learn that we have collected personal information from a child under the age of 13, we will promptly delete that information. If you believe we might have any information from a child under the age of 13, please contact us.

Information We Collect Automatically. We collect certain information automatically as you use our Site, such as: IP address; browser type; computer or device type; operating system version; website from where you navigated to our Site; time and date of using our Site; the pages on our Site that you view; the name of your Internet service provider (ISP); location / geolocation information; and cookies. This information is non-personally identifiable information about you which is made available by your browser, computer hardware and/or software. This information is used to operate the service, to maintain and improve quality of the service, and to provide general statistics regarding use of our Site.

Cookies. When you visit our Site we send one or more "cookies" to your computer or other device. A cookie is a small file containing a string of characters that is sent to your computer when you visit a website. A pixel tag can collect information such as the IP (Internet Protocol) address of the computer that downloaded the page on which the tag appears; the URL of the page on which the pixel tag appears; the time the page containing the pixel tag was viewed; the type of browser that fetched the pixel tag; and the identification number of any cookie on the computer previously placed by that server.

Third Party Advertising Companies. We do not allow advertising companies to collect data through our service for targeted or interest based advertising. We may disclose some or all of the information we collect, as described above, to companies that perform marketing services on our behalf. We may also disclose non-public personal information about you to other nonaffiliated companies for our everyday business purposes, such as to process transactions, maintain accounts, and report to credit bureaus. However, we do not disclose such non-public personal information to affiliates or nonaffiliated third party companies for their own marketing use.

3. HOW WE USE AND SHARE YOUR INFORMATION

To Provide Products, Services, and Information. As described above, we collect information from you so that we can provide the services made available to you using the Site, and provide information that you request from us. We use your personal information to contact you, provide the services to you and to respond to inquires from you. We may provide information to third party service providers that help us provide and deliver the services to you. We may use third parties to help host our Site and send out email updates about the Site. We may also use yor information you with products, services, and information that match your interests and preferences. For example, we may use this information to fulfill your order, process payments on your behalf, respond to your inquiries, administer your account, improve our website, conduct research, display content based upon your interests, and allow you to search information on our Site.

Your Consent. In addition to the sharing described elsewhere in this Policy, we may share personal information with third parties when we have your consent to do so.

Legal Proceedings. Transfer in the Event of Sale or Change of Control. If the ownership of all or substantially all of our business changes or we otherwise transfer assets relating to our business or the Site to a third party, such as by merger, acquisition, bankruptcy proceeding or otherwise, we may transfer or sell your personal information to the new owner. In such a case, unless permitted otherwise by applicable law, your information would remain subject to the promises made in the applicable privacy policy unless you agree differently.

4. ACCESS TO YOUR INFORMATION AND CHOICES

If you have an online account, you can access and update certain information we have relating to your online account by signing into your account and going to Energy Manager. If you have questions about personal information we have about you or need to update your information, you can contact us. We will attempt to respond to your requests within 30 days. In some cases, it may take us longer to do so or we may not be able to remove your information, in which case we will let you know if we are unable to do so and why. You can opt-out of receiving marketing and promotional e-mails from us by using your Account page, and by using the opt-out or unsubscribe feature contained in the e-mails.

You may also close your online account by contacting us and requesting that we close your account and you may and ask us to remove your name and other personal information from our database, provided that we may retain a copy of the information for archival purposes, and to avoid identity theft or fraud. Notwithstanding, we will only retain your personal information for the period necessary to fulfill the purposes outlined in this privacy policy unless a longer retention period is permitted by law. Certain information may be retained indefinitely.

5. CALIFORNIA PRIVACY RIGHTS

California residents are legally entitled (at no charge and no more than once annually) to request information about how we may have shared your information with others for direct marketing purposes. You may contact us for this information via the methods set forth below in the contact us section.

6. SECURITY OF YOUR INFORMATION

We use industry standard physical, technical and administrative security measures and safeguards to protect the confidentiality and security of your information from unauthorized access or disclosure. This includes utilizing Secure Sockets Layer (SSL) software, which encrypts the information you input, and storing your information in encrypted form behind a firewall designed to block access from outside our network. However, since the Internet is not a 100% secure environment and no security or encryption method can be guaranteed to protect information from hackers or human error, we cannot guarantee, ensure, or warrant the security of any information you transmit to us. There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.
